So there's a difference between Marijuana and Hemp. Marijuana is bred for high THC and low CBD. Hemp is bred for High CBD and low THC…but you can still extract the psychoactive compounds from hemp and it's legal!
Specifically, the Agricultural Improvement Act of 2018, Also known as the Federal Farm Bill, descheduled certain Cannabis Products deemed to contain low levels of certain forms of THC, reclassifying these products as Hemp. It also allows for the transfer of these products across state lines given that they are lawfully produced.
As noted in section 10113 of the Farm Bill, Hemp cannot contain more than 0.3% Delta 9-THC by dry weight. Above that 0.3% threshold, products are considered non-hemp Cannabis, or Marijuana, and therefore are still considered Schedule 1 Drugs.
The legality of these Hemp derivatives, so long as they come from hemp plants and remain under the 0.3% threshold laid out in the Farm Bill, has been upheld by the 9th Circuit Court of Appeals in May 2022 in the decision: AK Futures V Boyd Street Distro.
